These Terms & Conditions ("Terms") govern your use of ARK Exotics' website, services, reservations, memberships, and vehicle rentals. By accessing our website, making a reservation, signing a rental agreement, or using any ARK Exotics vehicle or service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our services.

1. Company Information

ARK Exotics is operated by ARK EXOTICS LLC / BEAR VENTURES LLC ("ARK Exotics," "we," "us," or "our").

2. Rental Eligibility

To rent a vehicle from ARK Exotics, you must meet all eligibility requirements set by us at the time of booking or pickup, including but not limited to:

  • Being at least 21 years old, unless otherwise approved by ARK Exotics in writing
  • Holding a valid driver’s license
  • Providing a valid credit card
  • Providing proof of valid, collectible auto insurance that extends to rental vehicles and includes liability, collision, and comprehensive coverage
  • Providing any additional identification, documentation, or verification requested by ARK Exotics

Only drivers approved and listed by ARK Exotics may operate the vehicle. Unauthorized drivers are strictly prohibited.

3. Reservations, Payment & Authorization

Reservations may be made through our website, by phone, by text, or through an approved ARK Exotics representative.

  • Full payment may be required at booking or charged within 24 hours prior to scheduled pickup, depending on the reservation terms
  • A security deposit may also be authorized or charged prior to vehicle release
  • By making a reservation, you authorize ARK Exotics to charge the card on file for all rental charges, deposits, fees, tolls, mileage overages, damages, penalties, extensions, and any other amounts due under these Terms or your rental agreement
  • If any payment is declined, reversed, revoked, disputed, or otherwise fails to process, ARK Exotics may cancel the reservation, refuse vehicle release, retain prior deposits or fees where permitted, and pursue collection of any outstanding amount

You are responsible for maintaining a valid payment method and sufficient available credit from the time of booking through final vehicle inspection and closing of your rental file.

4. Cancellations, No-Shows & Refunds

Unless otherwise stated in writing by ARK Exotics, the following cancellation policy applies:

  • Cancellations made within 24 hours of booking may be eligible for a full refund
  • Cancellations made more than 48 hours before scheduled pickup may, in ARK Exotics’ sole discretion, receive a full refund if the reservation has not already become non-refundable under a signed rental agreement or special booking terms
  • Cancellations made within 48 hours of the rental start time may incur a cancellation fee of up to 50% of the rental cost
  • Cancellations made more than 24 hours after booking may result in forfeiture of the full payment if the vehicle was reserved and held exclusively for you
  • No-shows and same-day cancellations are non-refundable

Special event reservations, holiday reservations, membership bookings, promotional bookings, custom packages, or any booking marked non-refundable are subject to the specific terms provided at the time of purchase.

5. Vehicle Use

You are fully responsible for the vehicle from the moment it is delivered or picked up until it is returned and accepted by ARK Exotics.

  • You must obey all traffic laws and operate the vehicle safely and lawfully
  • You must maintain all fluid levels and immediately stop operating the vehicle if continued use may cause damage
  • You must return the vehicle on time, in the same condition it was rented, ordinary wear excepted
  • You must return the vehicle with the same fuel level required by ARK Exotics, typically full
  • You may not install, remove, alter, or tamper with any part, accessory, tracking system, or equipment without prior written approval

6. Prohibited Uses

The following uses are strictly prohibited and may result in immediate termination of the rental, full forfeiture of deposit, additional charges, denial of future service, repossession of the vehicle, and legal action:

  • Use by any unapproved, unlicensed, suspended, or unauthorized driver
  • Driving under the influence of alcohol, drugs, or any impairing substance
  • Exceeding 110 mph
  • Track use, racing, contests, speed events, burnouts, drifting, or performance driving events
  • Off-road use, unpaved surface use, or operation in conditions unsuitable for the vehicle
  • Driving out of state or outside any approved geographic area without written approval
  • Subleasing, ride-share, delivery, chauffeur, commercial, or for-hire use
  • Pushing, towing, or teaching someone to drive
  • Sitting or standing on top of the vehicle
  • Tampering with or disconnecting onboard GPS or tracking devices
  • Transporting pets unless expressly approved in writing
  • Smoking, vaping, drug use, or transporting substances that leave odor or residue
  • Use of glitter-based products in or around the vehicle, including glitter makeup, glitter body products, glitter-infused hair products, shedding nail products, or loose glitter in any form
  • Obtaining or extending the rental using false, misleading, or fraudulent information

7. Additional Drivers

Additional drivers must be approved by ARK Exotics in advance and may be subject to an additional fee. Unless otherwise stated in writing, the additional driver fee is $50 per additional driver per day.

Any damage, violation, or loss caused by an additional driver remains your responsibility.

8. Insurance & Liability

You affirm that you carry valid, collectible auto liability insurance with collision and comprehensive coverage that extends to rental vehicles. Your personal insurance is primary to the fullest extent permitted by law, including under Florida Statute 627.7263 where applicable.

You accept full financial responsibility for:

  • Damage to the vehicle
  • Theft or total loss
  • Third-party property damage or bodily injury claims
  • Loss of use
  • Diminished value
  • Administrative expenses
  • Towing, storage, recovery, impound, legal, and collection costs

If your insurance denies coverage, is insufficient, or does not apply for any reason, you remain personally liable for all amounts due.

ARK Exotics may, in its discretion, offer optional protection products or insurance-related packages, but such offerings do not relieve you of liability except to the exact extent stated in a separate signed agreement.

9. Damage, Loss, Repairs & Diminished Value

You are responsible for all damage to, loss of, or theft of the vehicle during the rental period, whether or not you are at fault. This includes, without limitation, damage caused by weather, road conditions, vandalism, unknown third parties, or acts of nature.

You agree to pay for:

  • All repair costs
  • The actual cash retail value of the vehicle if it is deemed a total loss or is not recovered
  • Diminished value, as determined by ARK Exotics or an independent appraisal
  • Loss of use at the applicable daily rental rate for the time the vehicle is unavailable
  • Lost revenue from canceled reservations caused by downtime
  • Administrative claim processing fees, including a $15 administrative fee per incident where applicable
  • Replacement of missing documents, keys, accessories, tools, or equipment

Any new damage noted at return that was not present at delivery or pickup is billable to you.

10. Security Deposit

A security deposit may be authorized or charged at or before pickup. ARK Exotics may apply the security deposit toward any amount owed under these Terms or your rental agreement, including but not limited to damage, cleaning, smoking, mileage overages, fuel, tolls, late fees, tickets, administrative charges, and collection costs.

Any remaining balance of the deposit, if applicable, will be released after final inspection and processing, less any authorized deductions.

11. Fees & Charges

You agree to pay all charges associated with the rental, including applicable taxes and all other amounts due under these Terms. Unless otherwise stated in writing, the following fees may apply:

  • Additional Driver Fee: $50 per additional driver per day
  • Refueling Charge: $10 per gallon or a $30 refueling fee, plus fuel cost, depending on the vehicle and booking terms
  • Smoke Odor or Residue Fee: $1,200
  • Animal Transport or smoking-related cleaning: up to $1,200 or forfeiture of deposit
  • Interior Detailing / Excessive Dirt / Glitter Fee: $800 or other reasonable cleaning fee based on condition
  • Late Return Fee: $200 per hour
  • Non-return / failure to return when due: $1,000 per day or the daily vehicle rate, whichever is higher, where permitted by law
  • Excess Mileage: $10 per mile over the agreed mileage allowance
  • Speed Tracking Violation: $1,000 fine plus possible full forfeiture of deposit
  • Toll Processing Fee: $1 per toll plus the actual toll amount
  • Parking tickets, toll violations, traffic citations, towing, storage, impound fees, court costs, collection costs, and legal fees: actual amount charged plus any applicable administrative fee
  • Returned payment fee: $50 or the maximum permitted by law, whichever is greater

ARK Exotics reserves the right to charge reasonable additional amounts for damage, cleaning, misuse, administrative handling, claim processing, recovery, or any other loss resulting from your rental.

12. Mileage, Fuel & Return Condition

You must return the vehicle:

  • On time
  • With the required fuel level
  • In the same condition in which it was delivered, ordinary wear excepted
  • Free of unusual dirt, stains, smoke odor, pet hair, glitter, residue, or any condition requiring extraordinary cleaning

ARK Exotics may perform a joint inspection with you at pickup and return, including checklists, photos, videos, time stamps, and related documentation. If the vehicle is returned after normal inspection conditions or after 4 PM EST, you remain responsible for any damage until ARK Exotics completes its inspection.

13. Late Returns & Extensions

Late returns are disruptive to operations and may affect subsequent bookings. If you anticipate being late, you must contact ARK Exotics immediately.

  • Late returns are subject to a $200 per hour fee unless another amount is stated in your signed rental agreement
  • Trip extension requests must be made at least 24 hours before the original return time
  • Extension requests are not guaranteed and remain subject to vehicle availability, payment authorization, and ARK Exotics approval
  • Unauthorized extensions may result in additional fees, deposit forfeiture, refusal of future rentals, repossession efforts, and legal action

14. Accidents, Theft & Reporting Obligations

In the event of any accident, damage, theft, vandalism, mechanical issue, warning light, seizure, or incident involving the vehicle, you must:

  • Notify ARK Exotics immediately
  • Notify law enforcement when required or when instructed by ARK Exotics
  • File a police report if applicable
  • Cooperate fully with insurance claims, investigations, statements, documentation requests, and recovery efforts
  • Not admit fault or settle claims on behalf of ARK Exotics without written authorization

Failure to promptly report an incident may result in denial of any protection, additional liability, and breach of these Terms.

15. Tolls, Citations & Violations

You are solely responsible for all tolls, parking tickets, traffic violations, camera violations, red-light tickets, speeding citations, towing charges, impound fees, and other penalties incurred during the rental period.

ARK Exotics may charge the card on file for these items, along with any administrative or processing fees.

16. Memberships, Passes & Non-Rental Services

If you purchase a membership, pass, club access product, or similar offering from ARK Exotics, additional terms may apply. Membership benefits, availability, lounge access, reservations, guest access, event access, and booking priority are subject to the specific plan you purchase and may be changed, suspended, or revoked in accordance with applicable program terms.

Unless expressly stated otherwise in writing, memberships do not guarantee vehicle availability on specific dates and are subject to blackout dates, approval, vehicle rotation, maintenance schedules, and operational constraints.

17. Website Use

You agree to use our website only for lawful purposes. You may not:

  • Use our website in a way that could damage, disable, overburden, or impair our services
  • Attempt to gain unauthorized access to our systems or data
  • Copy, scrape, reproduce, or exploit website content for commercial purposes without our written permission
  • Submit false booking information, fraudulent inquiries, or misleading personal details

All content on this website, including text, images, graphics, branding, and design, is owned by or licensed to ARK Exotics and may not be used without permission.

18. Personal Property

You are solely responsible for your personal belongings and the belongings of your passengers. ARK Exotics is not responsible for any loss of or damage to personal property left in, on, or around the vehicle, our offices, our lounge, or any service area, whether or not such loss was caused by negligence.

19. Right to Refuse Service, Cancel Reservations & Repossess Vehicles

ARK Exotics reserves the right to refuse service, deny a rental, cancel a reservation, withhold vehicle release, terminate a rental, or repossess a vehicle at your expense, with or without notice where permitted by law, if:

  • You violate these Terms or your rental agreement
  • Payment fails or appears fraudulent
  • Required documents are not provided
  • The vehicle is being misused, endangered, abandoned, or operated unlawfully
  • ARK Exotics believes, in its sole discretion, that releasing or continuing the rental would create risk to the vehicle, the public, or the business

20. Indemnification

You agree to indemnify, defend, and hold harmless ARK Exotics, ARK EXOTICS LLC, and their owners, managers, officers, employees, contractors, representatives, affiliates, successors, and assigns from and against any and all claims, demands, losses, liabilities, damages, fines, penalties, costs, expenses, and attorneys’ fees arising out of or related to:

  • Your rental, use, custody, or possession of the vehicle
  • Your breach of these Terms or the rental agreement
  • Any accident, injury, death, property damage, or third-party claim related to the rental
  • Any violation of law, citation, or administrative proceeding resulting from your use of the vehicle or services

21. Disclaimer of Warranties

To the fullest extent permitted by law, ARK Exotics provides its website, vehicles, and services "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

22. Limitation of Liability

To the fullest extent permitted by law, ARK Exotics shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of our website, services, memberships, events, or vehicles.

In all cases, ARK Exotics’ maximum aggregate liability for any claim arising from your booking or rental shall not exceed the amount actually paid by you to ARK Exotics for the specific transaction giving rise to the claim, except where prohibited by law.

23. Breach, Waiver & Enforcement

No waiver by ARK Exotics of any breach of these Terms shall be deemed a waiver of any other breach. Our delay or failure to enforce any right under these Terms does not waive that right. Acceptance of payment does not waive any existing or future claim.

You waive any recourse against ARK Exotics for criminal or civil action taken due to your breach of these Terms or the rental agreement, to the fullest extent permitted by law.

24. Modifications to Terms

ARK Exotics reserves the right to update, change, or modify these Terms at any time in its sole discretion. Changes become effective immediately upon posting to our website unless otherwise stated. Your continued use of our website or services after any update constitutes acceptance of the revised Terms.

25. Governing Law & Venue

These Terms and any dispute arising out of or related to your use of our website, services, memberships, events, or vehicle rentals shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law rules.

You agree that any dispute shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction and venue of those courts.

26. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

27. Entire Agreement

These Terms, together with any rental agreement, booking confirmation, membership terms, waiver, invoice, checkout page, signed authorization, or other written agreement provided by ARK Exotics, constitute the full agreement between you and ARK Exotics regarding the applicable transaction and supersede prior discussions or representations to the extent permitted by law.
